Terms of Service

1. Who we are

artist.dev (“artist.dev,” “we,” “us”) is operated by artist.dev LLC, a California limited liability company. Reach us at hello@artist.dev.

2. Who may use it, and who may pitch

You must be at least 13 years old to use artist.dev, and old enough to agree to these Terms where you live. Anyone can browse the leaderboard, listen, and send without an account.

To pitch an artist or claim a page, you need an account. Accounts are free, and sign-in is by emailed magic link — there is no password. You are responsible for keeping access to your inbox secure, for keeping the details on your account accurate, and for everything done under it. One person, one account: do not register more than one, create accounts by automated means, or impersonate anyone.

3. What artist.dev is

artist.dev is a daily leaderboard of artists that people pitch to each other. A pitch puts one artist forward, with a song and a short case, and the artist debuts on the day the pitch sets. A tap from an artist’s page out to Spotify, Apple Music, or YouTube is a send, and artists are ranked by the fans who send them, each fan counted once per artist per day. At midnight Eastern each day the ranking freezes and stays on the artist’s page as a dated result.

Songs play through the embedded Apple Music player. artist.dev does not host, store, or distribute audio, and does not accept file uploads. The service is free, and it is early and changing — features, limits, and rules may change, launch, or be removed at any time.

4. Your handle

You choose a handle, which is the address of your own activity page. A handle has to fit our character set and must not be reserved, misleading, or offensive. We may reassign a handle — including one in use — for example to give a verified artist their own name, or to deal with impersonation or abuse. Your account and its history are preserved if this happens.

5. What you may not do

You agree not to:

• Manipulate, inflate, or otherwise game sends, ranks, or any other signal, including through bots, scripts, fake accounts, or coordinated tapping.
• Get around, or try to get around, any cap, rate limit, or eligibility rule.
• Pitch content you have no right to share, or that infringes anyone else’s rights.
• Post anything unlawful, hateful, harassing, deceptive, spam, or malicious.
• Scrape, crawl, or harvest the site except as our robots.txt allows, and do not probe, overload, or try to break into it.

We may investigate and act as we see fit, including removing content, voiding sends, and suspending or closing accounts.

6. What you pitch, and the case you write

“Your content” is anything you provide through artist.dev — the artists you pitch, the case and the song links you write for them, your handle, and your profile. You are responsible for it and confirm you have the right to provide it.

You grant artist.dev a worldwide, non-exclusive, royalty-free licence to host, display, and distribute your content in order to run and promote the service. Pitches are public, and they are permanent until the artist claims the page. A pitch, its case, its ranking, and the fact that you made it are shown publicly and do not expire on their own; an artist who claims their page takes over what it shows from that point. Do not put anything into artist.dev that you do not want to be public.

7. Artists, their pages, and Apple Music

A page can be created for an artist from public Apple Music data before that artist has any account here — an artist is not a user until they claim their page, and may have a page about them without ever having agreed to anything. Artist names, recordings, images, and metadata belong to their owners. artist.dev claims no ownership of them and is not affiliated with, endorsed by, or sponsored by any artist, label, or streaming service, including Apple.

Apple Music is a trademark of Apple Inc. Playback happens through Apple’s embedded player and is governed by Apple’s own terms, not ours.

If you are an artist, you can have your page removed on request, no questions asked. Email hello@artist.dev and we take it down; a removed page cannot be pitched again. You can also claim the page and run it yourself instead.

8. Sends, ranks, and results

A send counts for the artist on the day it’s made. Sends, ranks, and dated results are recognition within artist.dev only: they have no monetary value, are not property or transferable, and confer nothing outside the site.

We may void sends we believe are fraudulent, made by bots, scripts, or coordinated tapping, or otherwise to manipulate a result. We may do so after a day has closed, which corrects the count and any ranking that rested on it. We may also recalculate, adjust, or reset any signal to fix an error or address abuse.

9. Pro

Pro is free. We grant it to an artist’s page for a set term, and it can lapse or be revoked. A Pro page shows the artist’s own links beside Apple Music. We set the term when we grant it, and some terms run for the life of the page. When a term lapses, or we revoke Pro for abuse or a broken rule, the page stays up and shows Apple Music alone. Pro is not a purchase, and nothing about it is owed to you.

10. Removing and editing content

We may remove or edit any content, or decline to show any pitch, at our discretion — to honour a removal request, to correct a page, to deal with abuse or spam, or to comply with the law. We are not obligated to show any pitch, and removing content is not an admission of anything.

11. Intellectual property

artist.dev itself — the name, the design, the text, and the software — belongs to us and is protected by intellectual-property law. Apart from your content and third-party content, you get a limited, personal, non-transferable licence to use the site for its intended purpose. Do not copy, sell, or reverse-engineer it except where the law allows.

12. Copyright

If you believe something on artist.dev infringes your copyright, email hello@artist.dev with: your contact details; a description of the work and of the material you say infringes it, and where it is on the site; a statement that you believe in good faith the use is not authorised; a statement, under penalty of perjury, that your notice is accurate and you are authorised to act; and your signature. We may remove material that is the subject of a valid notice and may close the accounts of repeat infringers.

13. Privacy

What we collect and why is set out in our Privacy Policy. Using artist.dev means your information is handled as described there.

14. Ending your use

You can stop using artist.dev at any time and ask us to delete your account by emailing hello@artist.dev. We may suspend or close your access at any time if we believe you have broken these Terms or to protect the site or its users. Clauses that should outlast the account — ownership, the disclaimers, the limits on liability, and indemnity — survive.

15. Disclaimers

artist.dev is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, secure, or error-free, or that any content, rank, or third-party link will be accurate or available. You use it at your own risk.

16. Limitation of liability

To the fullest extent the law allows, artist.dev LLC and its officers, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, goodwill, or profits, arising from your use of the site. Our total liability for any claim relating to the site will not exceed the greater of the amount you paid us in the twelve months before the claim, or US $100. Some places do not allow certain limits, so some of these may not apply to you.

17. Indemnification

You agree to indemnify artist.dev LLC and its affiliates against any claims, damages, and reasonable expenses arising from your content, your use of the site, or your breach of these Terms or of any law or third-party right.

18. Changes

We may update these Terms. If we make material changes we will update the date above and may give further notice. Continuing to use artist.dev after changes take effect means you accept them.

19. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules, and any dispute will be resolved in the state or federal courts of California — except where the law gives you the right to bring a claim elsewhere.

20. General

These Terms are the entire agreement between you and artist.dev LLC about the site. If any part is unenforceable, the rest stands. Our not enforcing a provision is not a waiver of it. You may not assign these Terms; we may, as part of a merger, acquisition, or sale of assets. Questions? hello@artist.dev.
